DEVELOPMENT CLAWBACK
In the event that consent is granted for the land to be developed for anything other than agricultural or equestrian use in the next 35
years the purchasers will pay the seller or their successors in title 35% of the increase in the value of the land with the benefit of
consent for development over the existing value of the land as agricultural land without the hope of development. The overage is
to be paid on the earlier of disposal or implementation of the consent.

If the site is sold as a whole Lot 1 and Lot 2 are sold on the basis that the buyer will be under an obligation to use reasonable
endeavours to secure a consent for residential development at the earliest opportunity. If Lot 2 is sold separately it will be sold
without this obligation.
